PixBoost Terms of Use / End User License Agreement (EULA)

Agreement to these Terms

By downloading, accessing, purchasing a subscription for, or using PixBoost, you agree to these Terms of Use / EULA and our Privacy Policy. If you do not agree, do not use the app or services.

1. PixBoost services

PixBoost provides photo editing tools that may include AI photo enhancement, background removal, old photo restoration, image upscaling, manual adjustment, magic eraser, AI filter templates, saving, and sharing. Some features may run on your device, while other features may require remote server processing and third-party AI providers.

We may add, change, suspend, limit, or discontinue features at any time, including for security, maintenance, legal compliance, provider availability, or product improvement.

2. Eligibility

You must be at least 13 years old, or the minimum age required by your local law, to use PixBoost. If you use PixBoost on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.

3. Your photos and content

You keep ownership of photos, images, masks, edits, prompts, and other content you provide to PixBoost. You grant PixBoost a limited, non-exclusive, worldwide license to host, transmit, process, modify, and display your content only as needed to provide, secure, troubleshoot, and improve the requested service.

You are responsible for ensuring that:

• You own or have permission to use the photos and other content you submit.
• Your use of PixBoost does not violate privacy, publicity, intellectual property, or other rights of any person.
• You comply with applicable laws and platform rules.

4. AI-generated and edited outputs

PixBoost may generate edited images using automated systems. AI outputs can be inaccurate, unexpected, incomplete, or unsuitable for your intended use. You should review results before saving, sharing, publishing, or relying on them.

PixBoost does not guarantee that outputs will be unique, error-free, non-infringing, or accepted by any platform or third party. Similar or identical outputs may be generated for other users.

5. Pro subscriptions, free trials, and billing

Subscription products

PixBoost may offer paid auto-renewable Pro subscriptions that provide access to premium AI photo editing features, including AI Enhance, Background Remover, Magic Eraser, AI Filters, Image Upscale, Old Photo Restore, and other advanced editing tools.

Product names, prices, trial availability, renewal periods, and features may vary by country, region, platform, promotion, and App Store configuration. The final price and subscription details are displayed in the app and by Apple before purchase.

Free trials

If a free trial is offered, it is available only under the conditions shown on the purchase screen and by Apple at checkout. Unless cancelled before the trial ends, the subscription will automatically renew and Apple will charge your Apple ID payment method.

Auto-renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, or as otherwise stated by Apple. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel subscriptions at any time in your Apple ID subscription settings after purchase. Deleting PixBoost from your device does not automatically cancel an active subscription.

Payment and refunds

Payments are processed by Apple. PixBoost does not receive your full payment card details. Refund requests are handled by Apple according to Apple's refund policies and applicable law.

Subscription verification

PixBoost may verify subscription status before allowing access to Pro features or server-side processing. If your subscription is expired, invalid, cancelled, refunded, revoked, or cannot be verified, Pro access may be limited until a valid subscription is restored.

6. Acceptable use

You agree not to use PixBoost to create, upload, process, distribute, or request content that:

• Violates any applicable law or regulation.
• Infringes intellectual property, privacy, publicity, or other rights.
• Contains sexual content involving minors or exploits, harms, or endangers children.
• Promotes violence, terrorism, self-harm, harassment, hate, or abuse.
• Creates deceptive impersonations, fraudulent documents, misleading endorsements, or harmful deepfakes.
• Attempts to bypass safety systems, subscription verification, rate limits, or security controls.
• Uploads malware, attempts unauthorized access, scrapes the service, or interferes with PixBoost infrastructure.

We may reject processing requests, limit access, or take other action when we believe content or behavior violates these Terms, safety policies, provider rules, or applicable law.

7. Third-party services

PixBoost depends on third-party services such as Apple, Cloudflare, AI providers, analytics providers, and crash reporting services. Their services may be subject to separate terms and policies. PixBoost is not responsible for third-party service interruptions, policy changes, or processing delays outside our control.

8. Intellectual property

PixBoost, including its software, user interface, designs, logos, feature names, visual assets, and technology, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in PixBoost.

You may not copy, modify, reverse engineer, sell, lease, sublicense, or distribute PixBoost except as permitted by law or authorized by us in writing.

9. Availability and changes

We aim to provide a reliable service, but PixBoost may be unavailable due to maintenance, network issues, App Store issues, third-party provider failures, high demand, security incidents, legal requirements, or other circumstances. We may update, suspend, or discontinue parts of the service at any time.

10. Disclaimers

PixBoost is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that PixBoost will be uninterrupted, secure, error-free, or that edits and AI outputs will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, PixBoost and its owners, operators, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to your use of PixBoost.

Where liability cannot be excluded, our total liability will be limited to the amount you paid for PixBoost during the three months before the event giving rise to the claim, or the minimum amount permitted by applicable law.

12. Indemnity

You agree to indemnify and hold PixBoost harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of PixBoost, your violation of these Terms, or your violation of any rights or laws.

13. Termination

You may stop using PixBoost at any time. We may suspend or terminate access to PixBoost if we believe you violated these Terms, created risk for us or others, abused the service, or if required by law or platform rules. Termination does not automatically cancel an active App Store subscription; you must cancel subscriptions through Apple.

14. Apple App Store terms

If you downloaded PixBoost from the Apple App Store, Apple is not a party to these Terms and is not responsible for PixBoost or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as related to your use of the app. Your use of PixBoost must also comply with the App Store Terms of Service.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we may provide notice in the app or by other appropriate means. Continued use of PixBoost after changes become effective means you accept the updated Terms.
